Warranty
Carlos Christopher Montejano León., hereinafter (“Gold Shield”), in its capacity as a retailer of various products, and through its commercial affiliates, third parties, manufacturers and distributors, guarantees that each of its products complies with the applicable legal provisions, and that they carry the warranty established for such purposes by the Federal Consumer Protection Law and the applicable legal provisions.
The warranty provided by Gold Shield covers our products solely against manufacturing defects during the first 90 calendar days counted after the end consumer has received and accepted the product. After this period, the warranty must be exercised directly with the manufacturer or distributor. This warranty does not include items falling within the following categories for reasons of both hygiene and quality:
- Health products or medical equipment.
- Beauty and personal care products.
- Intimate apparel, swimwear or shapewear / girdles
As well as any other item indicated by the applicable provisions or expressly stated in the advertising, packaging or in any other form of communication.
It is an indispensable requirement to enforce the warranty that the customer provide their purchase receipt when it is requested for the purposes that Gold Shield, its commercial affiliates, third parties, manufacturers or distributors deem necessary. Failure to present the aforementioned documentation within the indicated period, or abandoning the warranty process for longer than 3 calendar days, will automatically suspend the process.
Our products may extend their warranty beyond the period covered by our Gold Shield Warranty, provided this is expressly stated in the advertising, packaging or any other means of communication. The extended warranty of the products depends entirely on the commercial affiliate, third party, distributor or manufacturer of the product. Gold Shield is not responsible for nor involved in any of the warranty policies of the aforementioned parties. Gold Shield may provide the customer with information regarding service centers or procedures to enforce them.
Our Gold Shield Warranty does not cover damage resulting from any impact, drop or mishandling, resulting from the intervention of third parties or caused by misuse or improper use of the product (according to the recommendations indicated in the instructions or manual of each product). Both Gold Shield and its commercial affiliates, third parties, manufacturers and distributors reserve the right to request substantial evidence of the product failure as well as to inspect the item to rule out any of the conditions mentioned above.
In the event that Gold Shield, its commercial affiliates, third parties, manufacturers or distributors find irregularities in the product or the presence of any of the conditions mentioned above attributable to the end consumer, we reserve the right to void our Gold Shield Warranty. If the warranty does not apply, the shipping costs and expenses shall be borne by the end consumer.
Our Gold Shield Warranty service is at no cost to the customer. Gold Shield covers any shipping cost arising from transporting the product from the customer's address to our facilities and from our facilities to the customer's address. When the warranty exceeds the period covered by our Gold Shield Warranty, the end consumer is responsible for managing the entire process as well as covering each of the shipping costs to and from the offices of Gold Shield's commercial affiliate, third party, distributor or manufacturer within the Mexican Republic.
Gold Shield may be the provider of the extended warranty service beyond the 90 calendar days only when the service centers of the commercial affiliates, third parties, manufacturers or distributors are not located within the Mexican Republic. Gold Shield may act as an intermediary only as an additional service for the customer. The customer is responsible for covering all expenses generated by the transportation costs starting from the beginning of the warranty process.
The response time of our Gold Shield Warranty is 5 calendar days once the product has been received and accepted at our facilities. The end consumer, aware of this period, accepts the time it takes to deliberate the warranty process. The operating times of the extended warranty of our commercial affiliates, third parties, manufacturers and distributors may vary depending on their policies. Gold Shield is not responsible for them.
Our Gold Shield Warranty will at all times protect the interests of the end consumer. Gold Shield will offer a product alternative in cases where the product with a manufacturing defect cannot be replaced or repaired by the commercial affiliate, third party, manufacturer or distributor. When the above alternatives have been exhausted, Gold Shield will offer a refund for the total amount of the item along with all shipping expenses generated during the customer's purchase experience.
The end consumer of our Gold Shield Warranty accepts that the refund for the total amount of the purchase experience will be made within a period no longer than 48 hours once the final decision on their warranty has been communicated to the customer. The refund will be issued to the same account with which the payment was processed (Mercado Pago, PayPal, Credit or Debit Card or Bank Deposit). Under no circumstances will it be processed to an account other than the one used during the purchase process or through a different payment method. In the event that the end consumer carries out, directly with their bank or credit institution used to pay for the products, any process or procedure of cancellation, rejection, payment disavowal, or any other similar action, Gold Shield will be unable to make the refund indicated herein, and the end consumer must conclude their process.
Our Gold Shield Warranty policy is governed by the laws of the United Mexican States. Any controversy arising from this agreement, its existence, validity, interpretation, scope or fulfillment will be submitted to the Federal Consumer Protection Agency in Mexico City.
